Because e-cigarettes contain nicotine derived from tobacco, they are now subject to government regulation as tobacco products. If we don’t see any of the kind of science that should be there to demonstrate benefit, that’s an application that’s probably headed for a denial. But when it comes to kids, the harm reduction question doesn’t apply because kids should not be inhaling any of these products into their lungs. After further lawsuits and delays, some caused by the COVID pandemic, a September 2020 court-ordered deadline was established for companies to submit applications to FDA seeking to market their e-cigarette products in the United States. In this interview, Mitch Zeller, J.D., director of FDA’s Center for Tobacco Products, provides insights into how e-cigarettes are regulated and recent FDA actions on e-cigarettes.

Our study analyzed recent e-cigarette use patterns among US adults to monitor existing policies and guide the development of strategies to address potential health risks and improve public health. A recent national survey showed that about 10% of U.S. youth believe e-cigarettes cause no harm, 62% believe they cause little or some harm, and 28% believe they cause a lot of harm when they are used some days but not every day. FDA’s award-winning public education campaign, “The Real Cost,” continues to prevent youth from tobacco initiation and use. The risk is greater from illegally manufactured or modified vape products, which are more common in states where marijuana remains illegal. Youth and young adults had more than three times the odds of using fruit-flavored e-cigarettes compared to older adults. A 2017 study by Truth Initiative found 25% of survey respondents, aged 15-24, recognized a JUUL e-cigarette device when shown a photo of the product. And among those who recognized JUUL, 25% reported that use of this product is called “JUULing,” indicating that this product is so distinctive, it’s perceived as its own category. However, it’s likely that recognition is higher now given that JUUL’s sales market share continued to rise throughout 2018 and top out at 75% among U.S. e-cigarette sales in July 2019. With Americans puffing less each year, the cigarette industry sees ESDs and other smokeless products as financial saviors.

Public Health Consequences of E-Cigarettes reviews and critically assesses the state of the emerging evidence about e-cigarettes and health. This report makes recommendations for the improvement of this research and highlights gaps that are a priority for future research.
